Can you Coach a Client during a Deposition Recess?

NO!

The NJLJ reports:

Defendants in a class-action suit will get a chance to question a class representative about her conversation with her attorney during a deposition break so they can ascertain whether she was coached on her responses. U.S. District Judge Peter Sheridan upheld a decision by Magistrate Judge Esther Salas that allowed discovery into to be asked about what Deborah Hoffman’s lawyer Mark Cuker said to her during a break in a deposition. “Since improper coaching of a deponent during a short deposition break may undermine the truthfulness of the deposition testimony, the questioning of Ms. Hoffman as ordered by Magistrate Judge Salas is appropriate,”

Sheridan wrote in an opinion released Tuesday.
