N.J. COURT MAY TRY INJURY SUIT ARISING FROM AUTO ACCIDENT IN SOUTH AFRICA

The N.J. Law Journal reports:

A New Jersey man severely injured in an automobile accident while on a business trip to South Africa may sue in a Bergen County court, the state Supreme Court ruled on Monday. New Jersey’s “strong public policy of providing a forum for the redress of wrongs committed against its residents” outweighs any interest in trying the case in South Africa, the Court said, affirming a trial judge who denied a forum non conveniens motion by the defense. The Court, in Yousef v. General Dynamics Corp., A 88-09, also took into account that Amin Yousef of Budd Lake, now confined to a wheelchair, would be unable to return to South Africa for a trial because of his physical condition.
