Bill enacts civil remedy to fight against stalking

Bill would give Stalking Victims a Civil Cause of Action

The N.J. Law Journal reports:

A bill introduced Monday in Trenton would create a civil cause of action for people claiming to be stalked.

The bill, A-4086, would make a civil wrong of conduct prohibited under the criminal stalking statute, N.J.S.A. 2C:12-10, “whether or not the individual has been charged or convicted for the alleged violation.” The remedy would be “in keeping with a growing trend nationwide to expand recourse options available to a stalking victim,” says the bill’s statement.

Similar legislation has been passed in 10 other states: California, Kentucky, Michigan, Nebraska, Oregon, Rhode Island, South Dakota, Texas, Virginia and Wyoming.
